Account and Billing: Name, email, phone, company name, and payment details.
Customer Data: Any information you upload about your leads, customers, or contacts. You remain the Data Controller of this information; we act as the Data Processor.
AI Training & Inputs: Data, voice-to-text transcripts, and interactions used to prompt our AI features.
2.2 Information Collected Automatically
Usage & Device Data: IP addresses, browser types, device identifiers, and clickstream data.
Cookies: We use essential, functional, and analytical cookies. You can manage these via your browser, though some Service features may be limited.
2.3 Information from Third Parties
Integrations: If you connect 1stContact.ai to Google Workspace, Microsoft 365, or other tools, we receive data governed by those providers' permission settings.
3. How We Use Your Information
To Provide the Services: Managing your account, processing payments, and hosting your CRM data.
AI Feature Optimization: To refine the accuracy of our AI models and automation workflows for your specific workspace.
Service Communications: Sending system alerts, security notices, and administrative updates.
Marketing: Sending promotional content (where legally permitted) which you may opt out of at any time.
4. Sharing and Disclosure
We do not sell your personal information. We share data only in the following ways:
Sub-processors: We use third-party infrastructure (e.g., AWS, OpenAI, Stripe) to provide our Services. A list of our current sub-processors is available upon request.
Legal Compliance: To comply with a subpoena, court order, or similar legal process.
Business Transfers: In the event of a merger, reorganization, or sale of assets.
5. Data Removal and Your Rights
You have the right to access, correct, or delete your personal information.
Right to be Forgotten
If you wish to have your personal data permanently removed from our systems, you must submit a formal request to [email protected]. Please note that removing your data will result in the immediate termination of your account access and the loss of all stored Customer Data.
6. Data Processing Addendum (DPA)
For our corporate and Enterprise customers subject to GDPR or CCPA, our Data Processing Addendum governs the processing of Customer Data. This DPA is incorporated by reference into our Terms of Service.
7. AI and Machine Learning
Our Services utilize artificial intelligence to provide insights and automation.
Input Data: We process the data you provide to generate AI outputs.
Model Training: We do not use your proprietary Customer Data to train "global" AI models accessible by other customers without your explicit, opt-in consent.
8. Data Security
We employ industry-standard SOC 2-aligned security measures, including:
Encryption: Data is encrypted using AES-256 at rest and TLS 1.2+ in transit.
Access Controls: Restricted access based on the principle of least privilege.
Monitoring: Continuous threat detection and regular vulnerability scanning.
9. International Transfers
Your information is stored and processed in the United States. For users in the EEA or UK, we utilize Standard Contractual Clauses (SCCs) to ensure a level of data protection equivalent to that in the EU.
10. Regional Disclosures
California (CCPA/CPRA): We do not "sell" or "share" (for cross-contextual behavioral advertising) personal information as defined by California law.
Europe (GDPR): 1stContact.ai LLC is the Data Controller for user account data. For Customer Data uploaded to the CRM, we are the Data Processor.
11. Changes to This Policy
We may update this policy to reflect changes in law or our Services. We will notify you of material changes via email or a prominent notice within the platform.
